Appellate Court Dismisses Challenge to Same-Sex Marriage Recognition Order

An order issued by the Westchester County Executive in 2006 requiring recognition of some same-sex marriages did not go unopposed. On Dec. 30, 2008, however, the Appellate Division, Second Department, upheld the legality of the order, affirming a lower court dismissal of a suit claiming the order violated New York's state constitutional and statutory law.

    Most experienced intellectual property attorneys understand the significant role surveys play in trademark infringement and other Lanham Act cases, but relatively few are likely to have considered the use of such research in patent infringement matters. That could soon change in light of the recent admission of a survey into evidence in <i>Applera Corporation, et al. v. MJ Research, Inc., et al.</i>, No. 3:98cv1201 (D. Conn. Aug. 26, 2005).
