If you need information on product recalls, unsafe products, or would like publications on a variety of consumer-related topics, visit the Web site for the U.S. Consumer Product Safety Commission (CPSC), www.cpsc.gov.
The CPSC is charged with protecting the public from unreasonable risks of serious injury or death from more than 15,000 types of consumer products under the agency's jurisdiction. The CPSC's mission is to protect consumers and families from products that pose a fire, electrical, chemical, or mechanical hazard, or can injure children. These products include toys, cribs, power tools, cigarette lighters, and household chemicals. The agency's efforts have contributed significantly to the 30% decline in the rate of deaths and injuries associated with consumer products during the past 30 years.
The Web site offers information in both Spanish and English. If you click on “Recalls and Product Safety News,” you can find information on more than 4000 product recalls by searching the various topics on this page. You can search by month and year to learn what's been recalled. The July 2004 recalls included voluntary recalls of 43 range hoods by BSH Home Appliances Corp., of Huntington Beach, CA and 5900 Lawn Tractors and Riding Mowers by Simplicity Manufacturing Inc., of Port Washington, WI. The range hoods might have the blower motor installed with a screw that might penetrate the motor housing, posing an electric shock hazard to consumers. The recalled mowers' blades can continue to turn longer than 5 seconds after the operator leaves the seat, posing a laceration and amputation hazard.

In 1987, a unanimous Court of Appeals reaffirmed the vitality of the "stranger to the deed" rule, which holds that if a grantor executes a deed to a grantee purporting to create an easement in a third party, the easement is invalid. Daniello v. Wagner, decided by the Second Department on November 29th, makes it clear that not all grantors (or their lawyers) have received the Court of Appeals' message, suggesting that the rule needs re-examination.
Possession of real property is a matter of physical fact. Having the right or legal entitlement to possession is not "possession," possession is "the fact of having or holding property in one's power." That power means having physical dominion and control over the property.
