Forensic Domestic Violence Assessments

The forensic evaluator's report can be crucial to the outcome of a domestic violence case, but the wrong type of evaluation can undermine a strong case. Psychologists who put themselves into the shoes of the judge when making their evaluations step over the line of clinical evaluation and can alienate the fact finder. Obtaining an assessment from a forensic psychologist with the correct understanding of his or her role in the decision-making process can is crucial.

The Problem

Forensic clinicians who conduct custody evaluations or evaluations in family offense matters often have to assess issues related to domestic violence and address those issues in their reports to the courts. The importance of such attention in forensic assessments rests on both the critical importance of protecting victims from further abuse and the long-standing and robust research literature establishing strong connections between psychological problems in children and domestic violence. However, such assessments also involve some degree of professional peril, due to the gender-political dimensions of domestic violence issues, the emotional debates even among empirical researchers about how domestic violence is best understood, and the capacity for the forensic clinician to go astray in the clinical process or to be misunderstood by the court.
