Nonresident Director Subject to Personal Jurisdiction in Forum State

In First Trenton Indemnity Company, et al. v. River Imaging, P.A., et al, Docket No. MRS-L-149-01 (New Jersey Law Division, March 22, 2004), Michael Licamele (“Licamele”), a former director of defendant HealthCare Integrated Services, Inc. (“HIS”), moved to dismiss the complaint filed against him for lack of personal jurisdiction. The question presented to the court was whether a nonresident director of a Delaware corporation with its principal place of business in New Jersey, where it allegedly operated illegal MRI facilities, was subject to personal jurisdiction in a lawsuit for insurance fraud involving the facilities. The trial court found Licamele properly raised the affirmative defense of lack of personal jurisdiction, however, it ultimately denied his motion and held that he is subject to specific and general jurisdiction.
