Recently, Maine became the third state to be sued by the U.S. Department of Justice on behalf of the National Security Agency's ('NSA') domestic spying program. The Justice Department is seeking to block states' inquiries into whether large telecommunications companies cooperated with the NSA's request to provide customers' calling data without a court order.
In the most recent filing, the Justice Department sued Maine's Public Utilities Commission ('Maine PUC') in U.S. District Court, District of Maine, on Aug. 21, seeking to stop the Commission from requiring Verizon to explain whether or not it gave NSA the information it was seeking. The Justice Department argues that national secrets potentially could be exposed if companies are required to testify about their work with the NSA, or even to confirm that they have worked with the NSA on citizen surveillance.
Verizon representatives earlier this year told newspapers that they did cooperate, but they have stopped discussing the issue. This has led to several states' seeking to compel testimony, and to the Justice Department's seeking to stop the testimony.
