Removal to Federal Court Denied Where There Was No Evidence of Fraudulent Joinder
Where one defendant cannot demonstrate that another defendant was fraudulently joined to prevent removal to federal court, and where an issue of law has not been determined by the state court where the litigation would occur, the federal court will not assume jurisdiction.
