The U.S. District Court for the Central District of California granted summary judgment in favor of a TV show host and his attorney, sued by the owner of The Weekend in Vegas TV series for sending content removal requests to Amazon. ISE Entertainment Corp. (ISE) v. Longarzo, 17-9132. Amazon had rejected a removal request by Jeff Civillico, the show's co-producer and host, but complied with one by his attorney Gerald A. Longarzo Jr. (Civillico claims ISE hasn't been paying him his weekly show fee.) ISE then sued Civillico and Longarzo seeking “damages for false [Digital Millennium Copyright Act] DMCA Notice.” But District Judge Michael W. Fitzgerald
found: “Both Mr. Civillico's initial (and ultimately rejected) complaint to Amazon and Mr. Longarzo's subsequent complaint were not based on copyright concerns ….” The district judge added: “By requesting that Amazon removes the Series based upon infringement of Mr. Civillico's rights of publicity and privacy, Mr. Longarzo has not sent a DMCA takedown notice.”
