<i>Hernandez v. Robles</i>
The recent decision of the New York County Supreme Court in Hernandez v. Robles is a significant step forward in the effort to establish marriage rights for same-sex couples in New York. Of the five same-sex marriage cases currently pending in the State, Hernandez is, thus far, the only decision favorable to the plaintiffs. The courts in Samuels v. The New York State Department of Health and Kane v. Marsolais (Albany County), Shields v. Madigan (Rockland County) and Seymour v. Holcomb (Tompkins County) dismissed plaintiffs' claims. Hernandez offers the most thorough analysis of the constitutional issues involved in the same-sex marriage cases. The decision rests, in large part, on the due process provisions of the United States and New York constitutions.
