Major Breakthroughs for CA Couples

In the past month, California cemented its reputation as a leader in expanding the rights of gay individuals and couples through a key court decision and unprecedented legislative action. The two actions have been cited by LGBT proponents as evidence that legal precedent and public opinion are strongly on their side, while leaving conservatives questioning how much longer they can stem the tide of change.

Schwarzenegger's Opposition

On Sept. 6, the California legislature become the first in the U.S. to pass equal marriage rights legislation for same-sex couples. Without a vote to spare, the Assembly passed AB 849 by a 41-35 margin, less than a week after the Senate passed the bill by a 21-15 vote. AB 849, The Religious Freedom and Civil Marriage Protection Act, would amend the state's Family Code to define a marriage as a civil contract between two persons, instead of a civil contract between a man and a woman. The bill also reaffirms that no religious institution would ever be required to solemnize marriages contrary to its fundamental beliefs. With this vote, California became the first state in the nation in which the legislature has voted to end marriage discrimination.
