The Art and Science of Culling Data by Keyword

By Peter McLaughlin
June 28, 2006

e-Discovery is a large process that has become many smaller ones, each requiring expert and diligent attention. Culling large data sets by keyword is no different from other elements of e-discovery projects, except, unfortunately, in one sense: Although it's a process in electronic-discovery projects, it's one that too often doesn't receive the time or consideration it deserves.

It's sad, and a bracing return on an ill-placed investment, when this typical approach to keyword data set-culling is taken: Legal teams throw together a list of important people, products or transactions, apply a wild card or two, and figure that this tack will capture all the necessary documents for review.

Here's the reality: Constructing an effective keyword-culling strategy often requires a more systematic approach, including specialized skills, tools and reports. But the problem that some legal teams face when using the best approach is that the teams' members take for granted the additional time and attention that the right approach normally demands. And here's the good news: The payoff can be substantial. A skillful keyword search can maximize the completeness, accuracy and efficiency of a document review and production. It just makes sense, doesn't it?
