$4.5M Award for Fire-Retardant Clothes Catching Fire
A jury awarded $41.5 million to a boy who suffered third-degree burns to 90% of his body when his jersey and pants caught fire while riding his motocross bike. Provenza v. LeMans Corp., No. A446708, Eighth Judicial District Court of Clark County, Nevada, Jan. 16, 2007.
Joseph Provenza, who was 13 when he was injured in 2001, was wearing specialty motocross clothing made by Gear Racewear, Inc., which was supposed to be fire-retardant. Gasoline leaked from his bike and ignited. He sued Lemans Corp., which distributed the Gear Racewear shirt and pants, claiming breach of warranty. Bike manufacturer Yamaha Motor Co. was involuntarily dismissed before trial.
