Hospital Call Center Does Not Offer Medical Services
A New York court dismissed a medical malpractice claim against a hospital because the claim was based on the actions of a hospital administrative employee whose job was primarily to handle patient complaints, and the employee was not authorized to offer, and in fact did not offer, any medical services to the decedent. Clayton v. Memorial Hospital for Cancer and Allied Diseases, Slip Copy, 18 Misc.3d 1133(A), 2008 WL 442423 (2/19/08).
