Legal Travel Is Back: Post-Pandemic Tips for Lawyers Traveling for Trials

During the COVID-19 pandemic, the U.S. court system largely came to a standstill, with judges scrambling to conduct hearings via phone and video chat. As the availability of vaccinations increased and COVID-19 case numbers decreased, many courts across the country have resumed in-person trial operations. Law firms now face new challenges when it comes to planning for out-of-town trials, as the return to in-person proceedings requires coordinating travel logistics such as airfare, hotel reservations and technological needs.

Travel providers such as airlines, hotels and ground transportation companies are facing challenges due to a surge in demand, along with staffing shortages and increased costs. The Global Business Travel Association reported a 48% increase in prices for business air travel in 2022, and an additional 8% increase is expected by the end of this year, surpassing pre-pandemic levels. According to STR, the average U.S. hotel rate in spring 2022 was the highest monthly average on record, coming in at $146.61. In cities with high demand like Miami, the average rate in April 2022 was $329.50, a 30% increase from April 2019. The airline industry is also facing significant challenges, with higher costs, delays, schedule changes and overcrowded flights causing frustration for travelers globally.

What's more, in-person trials require a lot of planning and preparation, and technology considerations play a significant role in this process. From setting up a secure VPN to ensuring that a hotel has a high enough internet bandwidth, there are many technology concerns that lawyers must consider when traveling for trials.
