A California federal court rejected music streaming platform Musi’s request for a preliminary injunction against Apple, the Big Tech giant, in a breach-of-contract lawsuit. Musi filed a complaint against Apple on Oct. 2, 2024, in the U.S. District Court for the Northern District of California, after Apple removed the Musi app from Apple’s app store due to copyright infringement concerns. In addition to a preliminary and permanent injunction against Apple to restore the Musi app to the app store, Musi is seeking damages on its claims of breach of contract and breach of the implied covenant of good faith and fair dealing. In a December 2024 court filing, Musi accused Apple of partaking in a “backchannel scheme with music-industry conglomerates bent on Musi’s destruction.”
Federal Judge Eumi K. Lee denied the preliminary injunction motion in January without prejudice. Apple’s motion to dismiss was terminated as moot in anticipation of a future amended complaint from Musi.
