Consumer genetics company 23andMe’s bankruptcy in late March set off a scramble among consumers to delete their personal information held by the company, driven by fears of how an acquiring party might attempt to use or monetize their data.

But while the consumer response to this incident has been clear, the bankruptcy raised numerous questions about how equipped existing laws are to manage consumer data in bankruptcy proceedings, and whether company privacy policies are robust enough to address data transfers in the event of an asset sale.
