I never thought I would mention former Philadelphia Eagles center Jason Kelce in the same sentence as Merriam-Webster.
But a colleague recently reminded me that Merriam-Webster's word of the year for 2023 was "authentic." Defined as "not false or imitation: real, actual" or "true to one's own personality, spirit or character," many of us witnessed this special trait when we watched Kelce announce his retirement earlier this year. During the press conference, Kelce was raw and unapologetic as he recounted the significant accomplishments over his career. On one of the most emotional days of his life, he did what he always did: He showed his true self.
We hear a multitude of ideas and solutions for attracting and retaining lawyers and business professionals in today's ultra-competitive environment. Tellingly, when surveying the landscape of a multigenerational workforce operating in a mixture of hybrid and remote work, authenticity is essential to workplace satisfaction and loyalty.

The Stranger to the Deed Rule
In 1987, a unanimous Court of Appeals reaffirmed the vitality of the "stranger to the deed" rule, which holds that if a grantor executes a deed to a grantee purporting to create an easement in a third party, the easement is invalid. Daniello v. Wagner, decided by the Second Department on November 29th, makes it clear that not all grantors (or their lawyers) have received the Court of Appeals' message, suggesting that the rule needs re-examination.
