In tenant’s action for declaratory relief and rent overcharge damages, tenant appealed from Supreme Court’s grant of summary judgment to landlord dismissing the complaint and awarding landlord an order of ejectment and damages for unpaid rent and use and occupancy. The Appellate Division modified to deny landlord’s summary judgment motions, holding that questions of fact remained about whether the apartment had qualified for high-rent vacancy deregulation.
