Kingston’s Rent Stabilization Ordinance Upheld

In landlords’ action challenging the City of Kingston’s imposition of a rent stabilization scheme and orders made by the city pursuant to that scheme, landlords appealed from the Appellate Division’s determination upholding the scheme and the orders. The Court of Appeals affirmed, holding that the city had properly determined that its vacancy rate was below five percent, and that the city’s orders requiring refunds of rents pad before the scheme became effective were consistent with the 2019 Housing Stability and Tenant Protection Act (HSTPA).
