In tenants’ action for breach of the warranty of habitability by landlord, landlord and its affiliate appealed from Supreme Court’s certification of a proposed class. The Appellate Division modified to deny class certification against the affiliate, but otherwise affirmed, holding that tenants had demonstrated that common questions of law predominated.
