Town Did Not Obtain Prescriptive Easement to Discharges Stormwater Over Neighboring Land

In landowner’s action against the town for damages and an injunction against discharge of stormwater onto his parcel, the town appealed from Supreme Court’s award of damages and injunctive relief. The Appellate Division modified to deny injunctive relief, but rejected the town’s claim that it had acquired a prescriptive easement to discharge the stormwater.
